The mandate of the Legislative and Regulatory Affairs Division is to provide administrative and advisory support services to the Department of Health and Community Services in matters pertaining to legislation, regulation and by-laws, the legislative agenda of the House of Assembly and legal affairs generally. The Division also has the primary responsibility of working with self-regulated health professions with respect to interpretation, evaluation, and development/amendment of their legislation, regulations and by-laws. The Division is constantly evolving in response to the emerging needs of the health and community services system. The Division is specifically responsible for: Ensuring that provincial health and community services legislation and regulations and other authorities support the Department’s policies and programs. Facilitating legislative and regulatory change or the enactment of new legislation through the development of policy papers and submissions for consideration by Government. Processing requests for health and community services information pursuant to the Freedom of Information Act and the federal Access to Information Act and maintaining file records/electronic database of such requests. Working with Professional Licensing Boards (see list below) to update, modify and or create their specific legislative agendas, often including consultation processes involving their professional associations. Responsible for oversight with respect to implementation of recommendations flowing from Government’s White Paper on Regulated Occupations as they pertain to health professions. Responsible for assessing and evaluating requests from health professions seeking self-governing status. At the federal/provincial/territorial level, participating in the Working Group on Trade Agreements, providing advice and analysis on a variety of issues to the Advisory Committee on Health Human Resources (ACCHR) and the Conference of Deputy Ministers of Health that may impact on health and community services. Recent issues under consideration by the working group include compliance with Chapter 7 (Labour Mobility) of the Agreement on Internal Trade, occupational title protection under the federal Trade-marks Act and legal analysis of cross-border telemedicine projects. Working with the Department of Justice to obtain and provide legal advice on a variety of matters related to health and community services, such as legal proceedings and interpretation, legal actions involving the courts, legal reviews of documents including contracts and agreements. Providing analysis and advice to the Department with respect to policy papers and submissions developed for consideration by Government. Providing analysis and recommendations to the Department with respect to Memoranda of Understanding, Contribution Agreements, Service Contracts and similar documents.
